SMS Consent & Opt-In Policy

How we collect consent before sending any text message, what we send, and how to stop at any time.

Last updated: October 1, 2026

In one sentence: NeverLose sends text messages to one group of people — the law firms who hire us, on the cell phone number they give us and tick a box to confirm. We do not text the people who call those firms. We never buy or rent phone number lists, and we never send marketing texts. We do collect the contact details a firm publishes on its own website — but only to send that firm a short business email sequence — at most three emails — inviting it to call our demo line, never to text it. A firm is only ever texted after it hires us and gives us a cell number itself.

1. Who we are

NeverLose is an AI after-hours intake service for personal injury law firms and for criminal defense and DUI law firms in the United States.

When someone calls one of these firms and no one can pick up, our AI receptionist answers, takes the details, and books the consultation on the firm's calendar.

2. Who we text, and how consent is collected

We text the law firm, and only the law firm. There is no web form for the public, no purchased list, and no third-party lead source.

1

The firm hires us and gives us a cell phone number

After checkout, the firm fills in our secure onboarding page (or replies to our email) with the cell phone number where it wants case alerts. Nobody else can enter that number.

2

The firm ticks the consent box, in writing

On that same page the firm ticks a box that reads:

"Yes, I agree to receive these texts from NeverLose about calls Riley takes for my firm. Message and data rates may apply. Reply STOP to opt out."

We do not activate the service, and we send no messages, before that box is ticked. The submission is stored with a timestamp, so consent is verifiable for every message we send.

3

We do not text the people who call the firm

Riley takes a caller's phone number so the firm can call them back, and she reads it back digit by digit to make sure it is right. That number is never texted by us — it is passed to the firm in her notes and nowhere else.

Proof of consent: every text we send goes to a number a law firm typed in and confirmed itself, and each one can be traced to that submission, a timestamp and a record ID. Records are available to carriers on request in the event of a complaint.

3. What messages we send

All of our messages are transactional. We send no marketing, no promotions, and no newsletters.

Message typeWho receives itWhen
Case alertThe firmAt the end of every call Riley handles for the firm, with her notes and whether a consultation was booked
Service alertThe firmOnly if something goes wrong with the firm's line, so the firm can call the person back

That is the whole list. No message of any kind is sent to the person who called the firm.

Sample message

NeverLose: New case booked — Alex (example), rear-ended on I-17, Tue at 9:00 AM. Full notes below. Reply STOP to opt out.

4. How to opt out

Reply STOP to any message from us. You will receive one final confirmation that you have been unsubscribed, and then no further messages.

We also honor STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT. Opt-outs are processed immediately and automatically.

To opt back in, reply START or UNSTOP.

5. Message frequency and cost

Message frequency varies and depends on how many calls Riley takes for the firm. In practice it is one message per call she handles.

Message and data rates may apply. NeverLose does not charge for text messages.

6. Privacy

We do not sell, rent, or share phone numbers with third parties for marketing. The firm's number is used only to send that firm its own case alerts. See our Privacy Policy for full detail.

7. Quiet hours and applicable law

We follow the U.S. Telephone Consumer Protection Act (TCPA) and CTIA messaging principles, and we never use text messaging for cold outreach.

Quiet hours do not apply to the case alerts a firm asks us for: the whole point of the service is after-hours calls, so an alert is sent at the end of the call, whatever time that is — that is exactly what the firm signed up for, and it can turn the alerts off at any time by replying STOP.
